    josephmattsonjustice:

Joseph Mattson, Los Angeles modern-noir author of Empty The Sun, Eat Hell, and editor of The Speed Chronicles, Girlvert, as well as crafter of countless short stories in Slake, Ambit, The Wailing Wall and beyond is currently experiencing an actual non-fiction, living, breathing noir-nightmare that would make Orwell or Welles grimace in their own graves. Friends, fans and anyone interested in general justice and welfare of the innocent are humbly asking for all of your urgent support with this, and time is of the essence. Read on for the full story from Joseph himself, and in the meantime, please join us on December 4th at The Echo for a massive benefit throwdown, with Detective (James Greer of Guided By Voices, author of The Failure) and a special one time reunion of L.A. noir punks The Starvations.

“If you recall, my mother was killed by her husband (not my father) in a violent domestic assault. He was convicted of Homicide – Involuntary Manslaughter, the result of neglectful assault & battery; “involuntary” because while he meant to severely physically beat my mother, it is inconclusive whether or not he necessarily premeditated to kill her during this particular assault. He is serving 2 to 9 years in prison, meaning 2 mandatory plus a potential 7 more years at the parole board’s discretion—meaning, realistically, due to the state of Michigan’s debt problems, there’s a good chance he’ll walk after only 2 years.

I was appointed my mom’s personal representative when all of this started, which includes executor-ship of her estate with the probate court. Her “estate” is modest, comprising mostly of a small piece of land and money, both inherited by mother from her parents/my grandparents when they passed away. After first complying to and then reneging when it was time to sign, I offered the man a peaceful agreement separating their “estates” (basically, he would agree never to pursue what was solely hers/my blood family’s, and I would do the same in regard for what was his alone)—at my financial deficit as I paid for every single expense even remotely involving my mom’s death, a total of about $65,000, but I wanted to sever ties with this man and allow myself to grieve and honor my mother in peace as swiftly as possible—my mom’s killer/husband instead has been trying to sue me from prison to acquire my mom’s estate, my blood family’s little legacy.
The litigation began back in Feb. and my probate lawyers have confided to me over and over and over that I have nothing to worry about, that this is all just a process of filing acknowledgement of his petition and that there was no way a judge would sign off on any such order, not only morally but in accordance to common law.
In Michigan, specific “slayer” statutes are in place, in honor of the common law of inheritance/morality that states no person should benefit from killing another person—a killer shouldn’t be able to inherit from the person they killed/be rewarded with financial or any other gain for the act of killing the person they are in line to inherit from. However, these laws must be applied for order by the court according to protocol when the homicide is “Involuntary” in order to clearly establish malicious intent to harm that resulted in death, as opposed to “non-malicious” cases of Involuntary Manslaughter, such as an automobile accident at the mercy of icy roads wherein the driver was sober and had no intention whatsoever to harm someone who died as a result of the accident, for example.
I have discovered that my probate lawyers have misrepresented me across the board—they did not correctly file the application of the law revoking the killer’s/husband’s right to inheritance, which should have been starting point standard procedure but in failing to do so has led to a multitude of technicalities in the killer’s favor; they have misfiled numerous critical steps not only in this but all other processes of probate regarding my case; failed to withhold information or blatantly lied to me about special hearings and other critical dates and duties; acted on my behalf without my consent; ignored my direction as personal representative; and so much more—it’s simply mindboggling the degree of ineptitude and sabotage—to the point of waiving objection to a court-order requested by the killer’s attorney to release all of my personal information to him (bank records, phone records, tax returns, leases, titles, everything one would need if feeling revenge for testifying against them—including my journals, notes, articles, drafts, outlines—any writing—involving the assault, homicide,  and my mother’s death, violating my freedom to write), without any explanation as to why, completely violating my rights protected under Michigan’s Crime Victim’s Rights acts/laws, under which I and my immediate family are registered—directly putting me and my family at risk on multiple levels.
All of this misrepresentation culminated in an emergency injunction by the court ordering me to take out a $20,000 bond on the estate, in addition to $20,000 of legal fees and fines involved—these amounts plus invoices/fees already incurred now far outweigh the actual value of the estate—and all of which I, as personal representative, had to cover immediately, solely on behalf of the massive undermining by my lawyers, to avoid removal of my executorship status, being held in contempt of court, even more financial and other penalties, and avoiding issuance of warrants or further detrimental court orders—and to buy time with the court to clear up the godforsaken mess.
Needless to say, my lawyers were fired immediately. I have hired new counsel who specializes in not only probate cases that involve all manner of homicide and domestic assault, but also fixers for these types of legal messes, as well as civil litigation experts—due to their expertise, they are not cheap, and they are currently at work trying to reverse my former lawyers’ misrepresentation, call to order the revocation of the killer’s/husband’s inheritance status despite prior technicalities, nullify any of his legal status associated with my mother, as well as filing a civil wrongful death suit, not only in the hopes to recoup some of the massive losses, but also as insurance that I will never be bothered by this man and his family in any such manner ever again. Simultaneously, I have to work with the state dept. of corrections and his local and statewide authorities to ensure our safety and security—the safety and security of my child—and my family’s at large, in the fallout of the violation of my crime victim’s rights and my freedom to write.
This has completely wiped me out—the discovery of lawyer misrepresentation seriously came out of nowhere and shattering just 3 days after our son was born—the unexpected $40,000 + other expenses because of all this recent discovery was my nest egg for my son and to cover my little family in general between book contracts and so I could focus on finishing my novel-in-progress, Hexico, and I have no money whatsoever now to cover the incoming legal fees in fixing the mess, general living expenses, incoming medical bills etc. associated with the birth of my son, or anything else. Worst of all, it has compromised the very crucial early days and weeks reserved for peace and bonding with our newborn and has devastated Devri’s health—due to the stress and anxiety, she has been unable to recuperate from her 40-hour labor (not wanting this felon who killed my mother in our lives when our son was born was her #1 outside, invasive fear during pregnancy, and not only is her fear realized, the situation of it is beyond anything we could have imagined), culminating in her being hospitalized with a severe mastitis infection that prevents her from continuing to breastfeed, which has just sent her in a spiral of complicated and detrimental postpartum health issues.
I have never been so desperate for help—if you or anyone you know, any potential help in regard to anything mentioned, no matter to what degree—my back is against the wall and for the safety and health of my lady and my baby boy, I am humbled to the point of begging for your help:

                Humbly,
                Joseph Mattson

    fallforkeaton:

I just found out that you don’t need parental consent to stretch your ears.

I KNOW WHAT I’M DOING WHEN MY MOM IS OUT OF TOWN IN A COUPLE WEEKS.

You’ll be under my supervision then, kiddo. SO IT STILL ISN’T HAPPENING LOL.
